Trabajadores indocumentados y lesionados en el trabajo deben evitar consecuencias migratorias cuando afirman sus derechos bajo el Código Laboral de California al reclamar beneficios de compensación al trabajador.



Abogados de estos trabajadores deben conocer los derechos del trabajador no solo debajo del Código Laboral pero también debajo de la Ley de Inmigración y Nacionalidad (“INA”).


La ley de California protege a todos los trabajadores

El Código Laboral de California define como “empleados” específicamente a los trabajadores indocumentados. Código Laboral sección 3351. El Código Laboral sección 1171.5 deja claro que con la excepción del derecho de ser restaurado al trabajo, el estatus migratorio de un trabajador es irrelevante para todos los demás derechos y recursos disponibles bajo la ley. Por lo tanto, preguntas hechas en el transcurso de un caso de compensación dirigidas a trabajadores indocumentados que tienen que ver con estatus migratorio o autorización para trabajar legalmente no sólo son irrelevantes en la acción de compensación a los trabajadores, sino que también las respuestas pueden estar sujetas al privilegio de la 5ª Enmienda contra la autoincriminación debajo de la Constitución.


Sin embargo, es común que al trabajador lesionado se le hagan preguntas que aunque aparentan ser inofensivas, las respuestas pueden tener impacto negativo en el caso de inmigración del trabajador lesionado e indocumentadoo.


Cuestiones relacionadas a como se obtuvo el empleo

La defensa en un caso de compensación de trabajadores tiene el derecho legítimo a realizar un proceso de descubrimiento en el caso, por ejemplo, tomando la declaración jurada del trabajador – una sesión de preguntas y respuestas donde el trabajador lesionado responde a las preguntas bajo pena de perjurio. Pero las declaraciones pueden ser salpicadas con preguntas que un trabajador indocumentado debe evitar responder o debe responder de una manera que evite consecuencias no deseadas.


Generalmente, un trabajador indocumentado nunca debe contestar las preguntas hechas por el abogado defensor que tienen que ver con cómo se obtuvo el empleo. En primer lugar, esto es irrelevante para las cuestiones que importan en un caso de lesión de trabajo. En segundo lugar, las respuestas podrían someter al trabajador a sanciones penales o de inmigración. Por ejemplo, si el trabajador indocumentado hizo declaraciones falsas en formularios federales de empleo, podría ser acusado de fraude y puede exponer al trabajador a consecuencias tanto penales como de inmigración. Y las sanciones severas de inmigración atarían a una admisión por el trabajador que él o ella se represento falsamente como ciudadano/a de los Estados Unidos para conseguir empleo.


Del mismo modo, contestar preguntas que detallan cómo se obtuvo un número de Seguro Social o de a quién le puede pertenecer el numero usado son igualmente irrelevantes y problemáticas para el trabajador lesionado indocumentado. Las respuestas pueden ser utilizadas contra él o ella en procedimientos penales bajo Cal. Código Penal sección 529 [suplantar a otra persona] o sección 530.5 [uso ilegal de la información personal de otra persona] o de bajo de leyes penales federales. Y aun cuando una condena criminal bajo estas leyes puede ser difícil de obtener para el fiscal, especialmente donde el trabajador no utilizó el seguro social de otra persona conscientemente, si la contestación puede ser violación de ley, puede ver consecuencias para el trabajador.


Por estas razones, el abogado del trabajador lesionado indocumentado debe ser consciente de estas posibles cuestiones y estar listo para defender al solicitante de las preguntas que podrían crear problemas para el trabajador fuera del caso de compensación.


Cuestiones relacionadas a inmigración


Otra línea común de preguntas que surge en una declaración en un caso de compensación es sobre viajes hechos por el trabajador fuera de los Estados Unidos. Por lo general, el asunto detrás de estas preguntas es legítimo – si cualquier otra lesión o lesiones sufridas por el trabajador en otro país podrían ser responsables por los síntomas médicos – una cuestión relevante para un caso de compensación de trabajadores. En segundo lugar, atestiguar a ausencias periódicas de los Estados Unidos puede llevar a consecuencias aún más graves. Lo más obvio es cuando hay varias entradas ilegales. Esto implica a secciones de ley que podrían prohibir al inmigrante de los Estados Unidos por hasta 10 años sin la posibilidad de un perdón.
